"Ejar": Standardized contracts and network services reduce disputes between contracting parties and protect their rights.

The Ejar program emphasized the excellence of its standardized contracts, which are documented on the electronic network for rental services, in preserving the rights of both parties to the rental contract, and its integration with a number of relevant authorities in the same regard.

Ejar explained that many of the services and features included in the unified contract preserve the rights of the parties involved in the rental process and reduce disputes in the real estate rental sector by documenting contracts, registering data on real estate units, and activating their use as enforceable documents, in a way that serves the program’s basic objectives of organizing and facilitating the procedures of the real estate rental sector, enhancing confidence in it, and achieving a balance that preserves the rights of the parties involved in the rental process and encourages investment.

He added: Among the advantages offered by “Ejar” is the electronic documentation of contracts via the network, where standardized lease contracts - both residential and commercial - are treated as enforceable instruments, to preserve the rights of the parties and to be used with judicial authorities in case of dispute, as one of the parties to the contract can register the contracting event (registering a contractual case) on the network, in addition to the diversity of standardized contracts between a fixed-term contract that ends on the date of the contract's expiry, or a contract that is automatically renewed, which one of its parties can cancel or amend after notifying the other party for a period of no less than 60 days, in addition to electronic contracts that accommodate the additional requirements of the contracting parties; and the inclusion of additional clauses according to the agreement between the parties to the contract, or non-standardized commercial contracts, all of which are documented on the network, and through which all the advantages of “Ejar” can be benefited from, but they are not treated as enforceable instruments.

The program includes a series of services provided by the network and continuously developed, which contribute to reducing disputes and preserving the rights of the contracting parties. These services include the electronic receipt and delivery of rental units, which proves the condition of the rental unit upon receipt and delivery, and the rental conduct service, which raises the level of quality and transparency in dealings between the parties to the rental process. It also includes strategic partnerships with service providers to enable the beneficiary to transfer services in the name of the actual beneficiary of the rental unit. In addition, it provides proof of financial transactions between the parties to the rental process through electronic payment and the availability of various payment channels for paying rent installments, including "Mada" and "SADAD." Electronic payment processes have made cash transactions unnecessary for the contracting parties (landlord and tenant), and have been considered an approved proof of rent payment, fulfilling the beneficiaries' desires to facilitate the payment process, as partial or future rent payments are possible.

It is noted that Cabinet Resolution No. (292) dated 16/05/1438 AH regarding strengthening the rules of trust in the housing rental sector stipulates that a lease contract not registered on the electronic network shall not be considered a valid contract producing its administrative and judicial effects, and that the Ministries of Justice and Housing shall set the conditions and requirements that must be met in the contract in order for it to be considered registered on the electronic network, and the cases that can be included in this, including the case of one of the parties to the contract refusing to register it.
