Secretary General of "Wafi": The unified contract guarantees the rights of all beneficiaries... and sales licenses have increased by 68% in 3 years

The Secretary-General of the Off-Plan Sales and Leasing Committee, Naif bin Nawaf Al-Sharif, revealed that the program issued 108 licenses from 2019 to 2021, totaling 85,530 real estate units, with an increase rate of up to 83%. He confirmed that real estate marketing licenses increased by up to 68%, with a total of 121 marketing licenses, and 464,116 units for off-plan projects inside and outside the Kingdom.

Al-Sharif explained that one of the most important functions and roles of "Wafi" is monitoring projects, stressing that 411 violating projects were detected during the period from 2019 to 2021. Among the most prominent of these violations is practicing the activity of marketing and displaying off-plan projects without obtaining the necessary licenses from the committee. He pointed out that the growth in monitoring reached 422% in light of the increasing volume of real estate development in various regions of the Kingdom, as violations are dealt with in two stages: stopping marketing and displaying until the project is completed and then marketing and selling, or by correcting the violation and issuing the license after that from "Wafi". He stressed that those affected can cancel the contracts and recover their money if the violation is not addressed and the license is not issued.

The Secretary-General of the Off-Plan Sales and Leasing Committee pointed out that the volume of stalled projects does not exceed 2%, while there are delayed projects that were affected by the Corona pandemic, which caused the time plans for implementing the projects to be in line with the precautionary measures during the pandemic. He noted that additional visits to the construction sites were scheduled by the engineering team following up on the completion of the projects, some of which were scheduled and others were surprise visits to ensure the developer’s commitment to the corrective plans.

Al-Sharif emphasized that the unified off-plan sales contract guarantees the rights of all beneficiaries, noting that the contract clauses guarantee the beneficiary's right in case of delayed delivery. He added that the force majeure clause, which includes unexpected incidents that hinder development or delivery work, such as natural disasters and pandemics and the resulting disruption to the delivery of services such as electricity, water, and sewage, leads to another clause, which is the delay in delivering the project for a period of six months from the actual delivery date according to the approved sales contract for the project.

He pointed out that “Wafi” currently oversees 117 projects in various regions of the Kingdom, including 46 projects that have been completed and are largely ready for handover. There are some challenges in introducing services according to the procedures and regulations with the service providers. He noted that the program’s role is to supervise and monitor the developer’s commitment to the contract, specifications, standards and requirements in establishing the unit. After completion, the developer submits a request to the relevant authorities according to their regulations to introduce the service. He indicated that there are 29 projects ready for handover and awaiting the regulatory procedures for introducing services.
