"Malak": More than 800 associations approved for off-plan sales projects

During its participation in the Maskan Real Estate Exhibition currently being held in Riyadh, the Malak program announced that it has approved more than 800 owners' associations for off-plan sales projects, after obtaining the necessary approvals to establish the associations and appoint the developer as the head of the association, through sales contracts attached to the disclosure form that contains the name of the association, the name of the president, the property manager, the amount of proposed subscriptions, and the real estate unit data.

The program explained in a press statement that the goal of adopting off-plan sales associations is to preserve the rights of beneficiaries of off-plan sales products and enhance confidence in these products, so that the new owner is fully aware of the housing unit and its obligations, from subscription fees to the property manager and the head of the association and other decisions related to the unit. Previously, the practice was to establish the association after obtaining the title deeds, which caused a gap between the developer's exit and the establishment of the association by the owners, due to the nature of these projects and the varying delivery of units in them and the lack of mandatory registration in the association, which leads to the failure to establish the association and activate it correctly.

The program confirmed that if the real estate developer fails to disclose the necessary information for off-plan sales projects, the buyer has the right to terminate the sales contract within 30 days starting from the date of its signing, or from the date of becoming aware of that information if it is essential and its concealment results in harm to him or the unsuitability of the subdivided real estate unit for use in the purpose for which it was purchased. The buyer shall not bear any costs arising from the termination of the contract, based on the second paragraph of Article Six of the system.

This collaborative work between the Owners Association and other initiatives aims to facilitate the adoption and activation of owners associations for off-plan sales projects for jointly owned properties with real estate developers, preserve rights and ensure the sustainability of the property, guarantee its proper use, and promote a culture of coexistence. It also aims to create a comprehensive picture of the role of the Owners Association in promoting a culture of good neighborliness to improve the real estate environment and its quality. The Owners Association is concerned with organizing the relationship between owners and occupants of jointly owned real estate units, through the development of regulations, control mechanisms, and the organization of facilities management services, as well as carrying out educational and awareness-raising activities, in order to ensure the preservation of rights and proper use, and to promote a culture of coexistence.
